Terms of Use

Preamble

The R Shiny applications at https://apps.leibniz-psychology.org/ are provided free of charge by ZPID, Universitätsring 15, in 54296 Trier. They were developed to help you create study protocols that contain all the relevant information for creating a preregistration or reporting deviations from a preregistration in a user-friendly manner. The apps are hosted at a server ZPID rents from Hetzner Online GmbH and technical support is provided by eoda GmbH. The apps were developed at ZPID, the Leibniz Institute for Psychology in Trier, Germany.

  1. Conduct: Users must not use the website in any way that disrupts its operation or the experience of other users, including but not limited to sending spam, introducing viruses, or engaging in other harmful activities.
  2. Suspension and Deletion: ZPID reserves the right to suspend the use of the service without notice if these Terms of Use are violated or if there is reasonable suspicion of misuse.

C) Rights to use the Applications

ZPID grants you a non-exclusive right to use the Applications according to their purpose explained in the preamble. All other rights are reserved.

D) Limitation of Liability

  1. Disclaimer of Warranties: ZPID provides no warranty for the Applications, for example regarding the accuracy, completeness, or timeliness of the Applications. The use of the applications is at the user’s own risk.
  2. Liability Exclusion: ZPID is only liable for intentional or grossly negligent behaviour in relation to the provision of the Applications. Furthermore, liability for consequential damage is excluded. In the event of gross negligence, liability is limited to foreseeable damages.
  3. Exception of the Liability Exclusion: The exclusion and limitation of liability shall not apply to damages resulting from injury to life, body or health, to damages resulting from the breach of essential contractual obligations (so-called cardinal obligations) or to liability for warranted characteristics or properties. In the event of a breach of cardinal obligations, liability for slight negligence is limited to foreseeable damages. No liability is assumed for the suitability of the Applications for the purposes intended by users.

E) Data Protection

The use of the Applications is subject to ZPID’s Privacy Policy, which forms an integral part of these Terms of Use. By using the Applications, you agree that ZPID collects, stores, and uses your personal data as outlined in the Data Privacy Note.

F) Miscellaneous

  1. Applicable Law: These Terms of Use are governed by the laws of the Federal Republic of Germany.
  2. Unenforceable Clauses: If any clause of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain effective and such terms shall be replaced with terms consistent with the purpose and intent of these Terms of Use.
  3. Update of these Terms of Use: ZPID reserves the right to modify these Terms of Use, especially in the event of a change in the legal situation or case law. In such cases, you agree to the amended Terms of Use by continuing to use the services. If you do not agree to the amended Terms, you may stop using the Applications at any time without notice.
